- Abstract
- The study on how rape victims can be compensated in Zimbabwe, specifically focusing on Mount Darwin District, reveals significant gaps between the constitutional provisions and their practical implementation. Despite the progressive legal framework introduced by the 2013 Constitution of Zimbabwe, which emphasizes gender equality and protection from violence, the practical application of these rights remains limited. The research highlights systemic challenges such as resource constraints within law enforcement agencies and social welfare departments, which undermine efforts to provide justice for rape survivors. Cultural practices that prioritize informal resolutions over formal legal processes further complicate matters. The study also identifies several challenges faced by survivors and victims of rape in Mount Darwin District in accessing compensation. A significant barrier is the lack of awareness about legal rights and compensation mechanisms among survivors, which is compounded by cultural stigmas and insufficient institutional support. Corruption within the judicial system exacerbates these issues. The absence of dedicated compensation funds for rape victims leaves many without recourse, highlighting a critical gap in policy implementation. Regarding the feasibility of implementing a state-backed compensation system for survivors and victims of rape in Zimbabwe, the study underscores economic challenges such as budgetary limitations and sustainability concerns. The need for enabling legislation that clearly defines eligibility criteria for compensation schemes is crucial to ensure transparency and accountability. Social implications, including stigma and social exclusion faced by survivors, must be addressed through community-based support systems that prioritize holistic well-being alongside financial assistance. Institutional capacity challenges, such as inadequate administrative infrastructure and training for personnel managing sensitive cases, must also be overcome to ensure effective implementation of a compensation system. Overall, while there is recognition of the necessity for enhanced support for rape survivors in Mount Darwin, achieving economic feasibility requires meticulous planning and strategic resource allocation.
